GC Leads Terms of Use

Welcome to GCLeads.ai, operated by GC Leads LLC, a Colorado limited liability company (“GC Leads,” “GCLeads.ai,” “we,” “our,” or “us”).

All references in this Agreement to GC Leads or GCLeads.ai refer collectively to GC Leads LLC and its owners, affiliates, and subsidiaries.

By accessing or using our website, products, data, or services (collectively, the “Services”), you (“Client,” “you,” or “your”) agree to be bound by the following Terms of Use (“Agreement”). Please read these terms carefully before purchasing or using any GC Leads data.

By purchasing, accessing, or using GC Leads data, you confirm that you are at least 18 years old and authorized to act on behalf of your company, brokerage, or organization. Use of GC Leads data is conditioned on your acceptance of these terms. 

All data provided by GC Leads, including lists, records, reports, or derivative materials (“GC Leads Data”), remains the sole property of GC Leads LLC.

You agree not to:

·  Sell, sublicense, share, transfer, or otherwise distribute GC Leads Data or any derivative work without prior written consent from GC Leads LLC.

·  Use GC Leads Data for any unlawful purpose, including but not limited to harassment, discrimination, or violation of privacy laws.

·  Represent GC Leads Data as your own proprietary product or include it in any public or commercial product offering.

·  Attempt to copy, scrape, or reproduce GC Leads systems, methodology, or delivery formats.

Unauthorized use, resale, or distribution of GC Leads Data may result in immediate termination of access and may lead to legal action. 

GC Leads LLC provides publicly sourced data and does not guarantee compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or state/federal Do Not Call (DNC) registries.

It is the sole responsibility of the Client to:

·  Verify and scrub data against applicable DNC lists prior to contact;

·  Obtain all necessary consent or opt-in before contacting individuals; and

·  Ensure compliance with all federal, state, and local laws governing marketing, solicitation, and data usage.

Client understands and agrees that any outbound marketing done that is not fully compliant is done so at their own risk.

GC Leads LLC will not be held liable for any fines, penalties, or damages resulting from Client’s use or misuse of the data. 

GC Leads LLC sources information from public filings (such as probate, tax delinquency, code violations, pre-foreclosure, and similar records). Because these filings are made by third parties and government entities outside our control:

·  GC Leads LLC cannot guarantee the number of new leads generated or their accuracy at any given time;

·  GC Leads LLC does not warrant that all records are current, complete, or error-free;

·  GC Leads LLC makes no promise of sales, profit, or business outcome resulting from the use of our data.

All GC Leads products are sold as-is, without any warranty of merchantability or fitness for a particular purpose. 

GC Leads data is typically delivered weekly, though delivery may vary based on lead type, volume, data availability, or holidays. Some markets may receive data biweekly, depending on county reporting timelines.

Delivery delays within a reasonable timeframe shall not constitute a breach of this Agreement. 

All GC Leads subscriptions are month-to-month unless otherwise stated in writing. Service automatically renews each month unless canceled as described below.

Payment

Payment is due in advance for each monthly term.

No data will be delivered for any month in which payment has not been received in full prior to the start of that month.

Certain counties or data sources may require one-time setup fees, special-access fees, or recurring county access charges. These costs will be disclosed and discussed with the Client prior to billing, but are subject to change without notice as they are determined by external county offices or third-party data providers and are outside the control of GC Leads LLC.

Refund Policy

Because GC Leads data is digital, proprietary, and delivered upon payment, all sales are final.

No refunds, prorations, or credits will be issued once data access or delivery has occurred.

GC Leads LLC reserves the right to suspend or terminate access to any client or account, with or without notice, for:

·  Non-payment, chargebacks, or disputed transactions;

·  Violation of these Terms of Use; or

·  Misuse, redistribution, or unauthorized sharing of GC Leads Data.

Upon termination, all rights to use GC Leads Data immediately cease. GC Leads LLC reserves the right to pursue legal action for damages or misuse.

To the fullest extent permitted by law, GC Leads LLC, its owners, employees, and affiliates shall not be liable for:

·  Any direct, indirect, incidental, or consequential damages;

·  Loss of revenue, profits, or goodwill;

·  Claims arising from your use, misuse, or inability to use GC Leads Data;

·  Any errors, omissions, or delays in data delivery.

·  Your exclusive remedy for dissatisfaction with the Services is to stop using them. 

GC Leads LLC may collect and retain limited client information for account and delivery purposes. You agree not to disclose GC Leads LLC’s proprietary processes, pricing, or client lists to any third party without written consent. 

You agree to indemnify, defend, and hold harmless GC Leads LLC and its affiliates from any claims, liabilities, damages, costs, or expenses (including attorney’s fees) arising from:

·  Your violation of this Agreement; or

·  Your use or misuse of GC Leads Data. 

This Agreement shall be governed by and construed under the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in the city and county of Denver.
